General Description: Under the supervision of the General Counsel, or designee, represents the Authority in civil litigation and administrative hearings, principally for the Authority’s Leased Housing/Section 8 program (Program). Provides ongoing legal counsel to Authority staff regarding Program. Supervises legal interns regarding this program.
Duties & Responsibilities: - Represents the Authority, principally regarding its Leased Housing/Section 8 Program (Program), in state and federal court in cases involving Program-related matters including administrative actions and policies, participant selection, reasonable accommodation, and discrimination.
- Represents, or supervises one or more legal interns to represent, the Authority at BHA or external administrative hearings involving administrative actions or policies in Program.
- Prepares and reviews pleading, correspondence, program-related documents.
- Advises Authority staff on application of state and federal laws and regulations to the operation of Program.
- Provides legal assistance in the development, drafting, and interpretation of Authority policies, implementation documents, and procedures.
- Prepares draft legislation and regulations, comments on proposed legislation and regulations and prepares legislative testimony.
- May provides supervision, training and evaluation of designated attorneys, paralegals, legal interns or support staff with regard to Program.
- Assists Department heads and other Authority staff in developing and implementing policies, guidelines, handbooks and training in Program related legal issues.
- May occasionally work outside counsel.
- Develops expertise in Program-related substantive areas of Law.
- May have some administrative responsibility within Legal Department.
- Perform other related duties as required.
Minimum Qualifications & Experience: Member in good standing of Massachusetts Bar or eligible for admission by reciprocity required. Good computer skills required. Minimum of two years of civil litigation experience, demonstrated expertise in publicly funded housing issues, and/or landlord/tenant law experience required. Excellent computer, communication, and writing skills required.
